Davies Collison Cave can assist you with patent protection in a number of South Pacific countries. We can directly file, or register patents previously granted in other jurisdictions (especially those granted in the United Kingdom).
Countries such as Brunei Darussalam, Kiribati, Solomon Islands, Turks and Caicos, Tuvalu and Fiji allow registration of UK patents. There is usually a strict 3-year time limit for registering UK patents in these jurisdictions, so they should be sent to us for registration as soon as possible. Other countries which may allow registration of UK patents include Anguilla, Bermuda, British Virgin Islands, Cayman Islands, Falkland Islands, Gibraltar, Guernsey, Guyana, Samoa, Seychelles, St Helena, St Lucia, Tonga and Vanuatu.
When filing applications based on a UK-granted patent, we usually require a certified copy of the patent for each jurisdiction. Other forms are completed and often require the signature of the patentee. The patents generally expire when the corresponding UK patent expires.
We can also file applications directly in jurisdictions such as Nauru, Papua New Guinea, Fiji, St Lucia and Tonga. While applications are currently being accepted in Nauru they do not have the resources to process them.
The patent registry offices in some of these countries are often associated with other government functions and do not have sophisticated processing systems. The filing, confirmation and certification of patents can often be quite protracted.
