Local Examination or Local Search and Examination

Deadline for request is 36 months from earliest claimed priority

(i)    Request for Local Examination: relies on an international (e.g, ISR) or foreign search report of a corresponding application. Examination conducted by IPOS or IPOS appointed foreign patent office.

Corresponding application is an application filed with a patent office in one of the following countries/region which forms the basis for a priority claim for the Singapore application, is subject to a priority claim based on the Singapore application, or is subject to a priority claim based on an application which is the basis of a priority claim for the Singapore application:

  • Australia
  • Canada
  • Japan
  • New Zealand
  • Republic of Korea

  • United States of America
  • Europe

(ii)    Request for Local Search and Examination: Original search and examination conducted by IPOS or IPOS appointed foreign patent office.

A Written Opinion may be issued with a non-extendible deadline of 5 months for response or amendments. To conclude the examination procedure, IPOS will issue an Examination Report.

If the Report is positive, a Notice of Eligibility to Proceed to Grant will issue and the application will proceed to grant upon submission of the requisite documents and payment of the requisite fees within 2 months of the date of the Notice of Eligibility to Proceed to Grant.

If the Report is negative, a Notice of Intention to Refuse will issue. There will be a 2 month period from the date of the Notice of Intention to Refuse to respond.

Global Patent Prosecution Highway (GPPH)

This route relates to expedited examination in Singapore which relies on applications made to Offices of Earlier Examination (OEE).

A request may be filed at any time before examination of the Singapore application has begun.

Request for expedited examination via the GPPH may only be applied for if:

  • Singapore application and application to OEE share the same priority date;
  • At least one claim from the OEE application is determined to be allowable/patentable;
  • All claims of Singapore application sufficiently correspond to claims found to be allowable/patentable by OEE.

Request for expedited examination via the GPPH requires:

  • Completed IPOS Patents Form 11, IPOS Patents Form 12 or a request in writing;
  • All office actions of the OEE application being relied upon;
  • Copy of the allowable/patentable claims of the OEE application; and

ASEAN Patent Examination Co-operation (ASPEC)

This route relates to expedited examination in Singapore which relies on applications made to ASEAN Member State (AMS). However, this route is unlikely to be used for applications filed in Singapore as Singapore has a faster prosecution process compared to the other AMS-es.

A request may be filed at any time before the final decision of grant or refusal is made.

Request for expedited examination via ASPEC may only be applied for if the Singapore application and application to AMS share the same priority date.

Request for expedited examination via ASPEC requires:

  • Completed IPOS Patents Form 11, IPOS Patents Form 12 or a request in writing;
  • Search and Examination report from the AMS;
  • Copy of claims of the AMS application with at least one claim determined to be allowable/patentable.
  • A claims correspondence table relating the claims of the Singapore application to the allowable/patentable claims of the AMS application.

Offices of Earlier Examination include:

  • Brunei
  • Cambodia
  • Indonesia
  • Laos
